Hushward terms of use

These terms are the contract between you and the provider of Hushward. You accept them on the Terms & privacy screen before your first story, so please read them first. The privacy policy explains how we handle personal data.
Key points
These points differ from what you might expect, so we ask you to accept them knowingly:
- Hushward is for adults. You must be 18 or over. It writes stories with AI for children to hear, and you operate the app.
- Stories are written by AI, and automated checks can miss things. Read each new story before you read it to a child, and report anything unsuitable.
- Your stories are saved only on your phone. If you lose the phone, uninstall the app or clear the device, they are gone, and we cannot restore them.
- Minutes are counted by length, not listening time. Story minutes follow the length you choose, narration minutes the length of the text. Monthly allowances renew each month and do not roll over. Bought minutes do not expire while your account exists, and are lost if you delete it.
- Subscriptions are sold and billed by Apple or Google and renew automatically until you cancel in the store. Deleting your account does not cancel a subscription.
- When a Premium plan ends, your voice copy is deleted.
- We do not promise that stories are unique or that anyone holds copyright in them.
1. Who we are
Hushward is provided by Pere Tamás egyéni vállalkozó (sole proprietor, e.v.): registered seat 1133 Budapest, Pannónia utca 87. 6. emelet 21. ajtó; registration number 62628505 in NAV's register of sole proprietors; tax number 92250107-1-41; email privacy@hushward.app; phone +36 30 217 4794. "We" and "us" mean the provider.
2. The contract
- Forming it. You enter your email address, receive a six-digit code and sign in. Until you send the code you can go back and correct the address. Signing in for the first time creates your account; accepting these terms on the Terms & privacy screen concludes this contract.
- Language. The contract can be concluded in English or Hungarian, the languages of the app. Both versions of these terms have the same content.
- Record. The contract is concluded electronically. We do not file a separate copy for each user; every version of these terms stays published with its date, so the version you accepted can always be found.
- We do not subscribe to a code of conduct.
3. Who can use Hushward
You must be at least 18 and use Hushward for yourself and your family, not for business. An account belongs to one person. Keep access to your email address and your phone secure; you are responsible for what is done through your account. Children should not use the app on their own.
4. What Hushward does
Hushward writes bedtime stories with AI from the subject and choices you give, checks the subject and the finished story for suitability, adds an illustration and saves stories on your phone for reading offline. Narration and your own voice are available on plans that include them.
Creating stories requires your permission to share your requests with our AI provider; without it no new stories can be created. Usage limits, such as how many stories can be created in a day or how many subjects can be checked in a week, protect the service and are shown in the app where they apply.
We work to keep Hushward available and to fix faults quickly, but it may be interrupted for maintenance, updates or outages at our providers. Your statutory rights if the service does not work as it should are set out in section 10.
5. AI-generated stories
- AI can make mistakes and produce strange or unsuitable text despite our checks. Facts in learning stories may be wrong, and stories are not advice of any kind.
- We may decline a subject that fails our checks.
- We do not claim ownership of your stories, and we do not promise that they are unique or protected by copyright; similar stories may be written for others. You are free to read, keep and share them with your family and friends.
6. What you must not do
- Ask for sexual, violent, hateful or otherwise unsuitable stories, or try to get around the safety checks.
- Use Hushward to infringe others' rights, including copyright and trademarks.
- Enter information that identifies or is sensitive about a child or anyone else, such as real names, schools or health details. Use invented names instead.
- Record any voice but your own, or use your voice copy to deceive anyone (section 8).
- Copy, reverse-engineer, automate, overload or resell the service, or break the law through it.
If you do, we may decline requests, limit features or end the contract (section 11).
7. Plans, minutes and purchases
Plans. The free plan (Little Star) includes a monthly allowance of story minutes. The paid plans, Moonlight and Dreamland, add minutes and features. Allowances, features and prices are shown in the app before you buy.
Minutes.
- Story minutes are deducted by the length you choose when a story is delivered. A story we fail to deliver, or decline in our checks, is not counted.
- Narration minutes are deducted by the length of the text at a fixed rate per language, rounded up to a whole minute. Replaying saved audio is free.
- The plan's monthly allowance renews on your plan's monthly date, including on yearly plans, and unused minutes do not carry over.
- Bought minute packs are used after the plan's minutes. They do not expire while your account exists and remain after a subscription ends, but they cannot be transferred or exchanged for money, and they are lost when you delete your account.
Buying. You buy through the App Store or Google Play, which take payment, issue receipts and apply their own terms. Prices include VAT where it applies.
Subscriptions renew automatically at the end of each period until you cancel them in your App Store or Google Play account. On the App Store, cancel at least 24 hours before the period ends. Moving to a higher plan starts at once; moving to a lower plan starts at the next renewal. When a subscription ends, your account returns to the free plan.
Refunds and withdrawal. Refunds are handled by Apple (reportaproblem.apple.com) or Google (through your Google Play order history) under their policies and the law. If you are a consumer in the EU or the UK you may withdraw from a purchase within 14 days, unless the law ends that right because digital content or a service was supplied at your express request. Your other statutory rights are unaffected. If you need help, contact us.
Price changes follow the store's rules: you are told in advance and asked to agree where the law requires it, and you can cancel before a new price applies.
8. Your own voice (Premium, if available)
You may record only your own voice, and only if you are an adult. The recording must contain the agreement shown in the app, read by you. We check that it contains the agreement, the words shown and a single voice before ElevenLabs makes the copy. Only your account can use your voice, only to read stories in the app, and the player labels it as an AI voice. Use it for stories you play while you are with your child.
You can delete your voice at any time. It is also deleted when you replace it, when your Premium plan ends and when you delete your account. Recordings already saved on your phone stay until you remove them.
9. Changes
To Hushward. We change and improve Hushward, and we may change features for a valid reason: a change in the law, security, a change at one of our providers, a technical need, or an improvement. If a change materially and negatively affects something you have paid for, we tell you at least 30 days in advance, and you may end your subscription free of charge, with a refund for the unused part, made through the store where it allows us to.
To these terms. We tell you about important changes in the app at least 30 days before they apply. If you do not agree, you may delete your account and cancel your subscription before then.
Ending the service. If we stop providing Hushward, we give at least 60 days' notice and refund unused subscription time and unused bought minutes, through the store where it allows us to.
10. Our responsibility
Hushward must work as described and as you can reasonably expect. If it does not, you have the remedies the law gives you, such as having the fault fixed, a price reduction or ending the contract. Tell us first so we can put it right.
We are responsible for loss that you suffer because we break these terms or fail to take reasonable care, if the loss was foreseeable when the contract was made. We are not responsible for loss that was not foreseeable, or for business losses.
Nothing in these terms limits liability for death or personal injury caused by negligence, for harm caused intentionally or through gross negligence, for fraud, or any other liability or consumer right that the law does not allow to be limited.
11. Ending the contract
You can stop at any time: delete your account in Settings → Delete my account, or through hushward.app/delete-account, and cancel any subscription in the store.
We may limit features, suspend your account or end the contract if you seriously or repeatedly break these terms, for example by trying to create harmful content, abusing the limits or cloning someone else's voice; if the law requires it; or where necessary to protect children or the service. We tell you why and, where reasonable, warn you first. If we end the contract through no fault of yours, we refund unused subscription time and unused bought minutes, through the store where it allows us to.
When the contract ends, your account data is deleted as the privacy policy describes. Stories saved on your phone stay there.
12. Complaints and disputes
Contact us at privacy@hushward.app, by phone on +36 30 217 4794 or by post to 1133 Budapest, Pannónia utca 87. 6. emelet 21. ajtó. We answer written complaints within 30 days and keep complaints and our answers for three years.
In Hungary you can turn to a conciliation board (békéltető testület), free of charge. The board for your place of residence is competent; the list of boards and their contact details is at bekeltetes.hu. If you do not live in Hungary, the competent board is the one for our seat: Budapesti Békéltető Testület, 1016 Budapest, Krisztina krt. 99. In the UK, if we cannot resolve a complaint, we tell you whether we agree to use an alternative dispute resolution provider. You can also go to court.
Law and courts. Hungarian law governs these terms. If you are a consumer living in another country, you keep the protection of that country's mandatory consumer law, and you may bring proceedings in the courts of the country where you live or in Hungary.
13. App stores
If you downloaded Hushward from Apple's App Store:
- These terms are between you and us, not Apple, and we, not Apple, are responsible for Hushward and its content.
- Apple has no obligation to provide maintenance or support for Hushward.
- If Hushward fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the price you paid for the app, if any. To the extent the law allows, Apple has no other warranty obligation for Hushward.
- We, not Apple, are responsible for any claims about Hushward, including product liability claims, claims that it fails to meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
- If anyone claims that Hushward or your use of it infringes their intellectual property rights, we, not Apple, will investigate, defend, settle and discharge the claim.
- You confirm that you are not in a country subject to a US government embargo or designated as supporting terrorism, and that you are not on any US government list of prohibited or restricted parties.
- You must comply with any third-party terms that apply when you use Hushward, such as your mobile data agreement.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
- Apple's standard licence agreement governs your licence to the app itself.
If you downloaded Hushward from Google Play, Google Play's terms also apply to your purchases.
14. Final provisions
These terms, the privacy policy and, for purchases, the store's terms are the whole agreement between us. If a provision is invalid, the rest stays in force.
